These Terms of Service ("Terms") govern your use of the NeverStop app and website ("the Service"), operated by NeverStop ("we," "us"). By using the Service you agree to these Terms. If you don't agree, please don't use the Service. Questions? neverstopbebetter@gmail.com.
NeverStop is a personal goal, habit, and fitness tracker with an AI coaching feature. It helps you set goals, log activity, build streaks, and stay accountable. It is a motivational and organizational tool — nothing in the Service is professional advice.
You may use much of the Service without an account. If you create one, you're responsible for keeping your credentials secure and for activity under your account. You must provide accurate information and be at least 13 years old. You can delete your account at any time inside the app, which permanently removes your account and synced data.
You own the content you put into NeverStop — your goals, logs, notes, photos, and profile information ("Your Content"). We claim no ownership of it. You grant us only the limited license needed to operate the Service: storing Your Content, syncing it across your devices, and transmitting relevant portions to our AI provider to generate the coaching replies you request. We don't sell Your Content or use it for advertising.
The Service itself — including the NeverStop name, the Rising N logo, the app's design, interface, graphics, text, code, features, coaching system, and all other materials (other than Your Content) — is owned by us and protected by copyright, trademark, and other intellectual-property laws. We grant you a personal, non-exclusive, non-transferable, revocable license to use the app for your own personal, non-commercial use.
You may not, except where the law expressly permits: copy, modify, distribute, sell, or lease any part of the Service; reverse-engineer or extract the source code, prompts, or design of the Service to build a competing product; use the NeverStop name or logo without our written permission; or remove or alter any proprietary notices.
AI-generated responses can be inaccurate, incomplete, or inappropriate for your situation. Use your judgment; you are responsible for decisions you make based on them. To generate replies, the goal and progress text you provide is processed by a third-party AI provider via our secure server — see our Privacy Policy for details.
NeverStop is actively developed. Features may be added, changed, or removed, and the Service may be unavailable at times. We may suspend or terminate access that violates these Terms. You can stop using the Service at any time.
The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including fitness for a particular purpose, accuracy, or uninterrupted availability. Your use of the Service is at your own risk — particularly regarding exercise and physical activity, which carry inherent risks of injury.
To the maximum extent permitted by law, NeverStop and its creator shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, profits, or goodwill, arising from your use of (or inability to use) the Service. Our total liability for any claim relating to the Service shall not exceed the amount you paid us in the twelve months before the claim (or $10 if you've paid nothing).
These Terms are governed by the laws of the United States and the state in which the operator resides, without regard to conflict-of-law rules. Disputes will be resolved in the courts of that jurisdiction unless applicable law requires otherwise.
We may update these Terms as the Service evolves (for example, when subscriptions or social features launch). Material changes will be posted here with a new effective date; continued use after changes means you accept them.
